Terms & conditions.
The terms governing the sale and purchase of Forest Air products through our website — applicable to customers in the United Kingdom, the European Union and worldwide.
1.1 These terms and conditions shall govern the sale and purchase of products through our website.
1.2 You will be asked to give your express agreement to these terms and conditions before you place an order on our website.
1.3 This document does not affect, exclude or limit any mandatory statutory rights you may have as a consumer under the laws applicable to you. Depending on your place of residence this may include, without limitation, the UK Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and — for consumers resident in the EU or EEA — Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods and Directive 2011/83/EU on consumer rights, each as implemented in your country of residence (in Germany, for example, in the Bürgerliches Gesetzbuch, BGB). Where any provision of these terms conflicts with such mandatory consumer law, that mandatory law prevails.
1.4 In these terms, a "consumer" is any natural person who is acting for purposes which are wholly or mainly outside that person's trade, business, craft or profession.
2.1 In these terms and conditions:
- (a) "we" means SOE Health Limited; and
- (b) "you" means our customer or prospective customer,
and "us", "our" and "your" should be construed accordingly.
3.1 The advertising of products on our website constitutes an "invitation to treat" rather than a contractual offer.
3.2 No contract will come into force between you and us unless and until we accept your order in accordance with the procedure set out in this Section 3.
3.3 To enter into a contract through our website to purchase products from us, the following steps must be taken: you must add the products you wish to purchase to your shopping cart, and then proceed to the checkout; you must enter your details and select your method of payment and confirm your order and your consent to the terms of this document; we will then send you an initial order acknowledgement; and once we have checked whether we are able to meet your order, we will either send you an order confirmation (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.
3.4 Before submitting your order you will have the opportunity to identify and correct input errors. Please review your order carefully before confirming it.
3.5 We will store the text of the contract (your order details and these terms). For your own records we recommend that you save or print a copy of these terms at the time of ordering.
4.1 The products available on our website are the Forest Air devices and related accessories.
4.2 We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product or type of product.
4.3 There may be variations in colour and appearance, and there may be minor imperfections of the type that a reasonable person would expect to see in such a product. In placing an order with us, you are accepting that these variations may occur.
4.4 Forest Air products are wellness devices. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Nothing on our website or in these terms constitutes a medical claim or medical advice.
5.1 Our prices are quoted on our website.
5.2 We will from time to time change the prices quoted on our website, but this will not affect contracts that have previously come into force.
5.3 For consumers, prices are shown inclusive of any value added tax (VAT) or equivalent sales tax that applies at the point of sale, unless stated otherwise. For business customers, prices may be shown exclusive of VAT, in which case VAT will be added where applicable. The applicable total, including taxes and delivery charges, is shown before you confirm your order.
5.4 For deliveries outside the United Kingdom (and, where relevant, outside the European Union), your order may be subject to import duties, customs charges and local taxes levied by the destination country. Where these are not collected by us at checkout, they are payable by you and are outside our control. Please check the requirements of your destination country before ordering.
5.5 It is possible that prices on the website may be incorrectly quoted; accordingly, we will verify prices as part of our sale procedures so that the correct price will be notified to you before the contract comes into force.
6.1 You must, during the checkout process, pay the prices of the products you order.
6.2 Payments may be made by any of the permitted methods specified on our website from time to time.
6.3 If you fail to pay to us any amount due under these terms and conditions in accordance with the provisions of these terms and conditions, then we may withhold the products ordered and/or by written notice to you at any time cancel the contract of sale for the products.
6.4 If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within 14 days following the date of our written request:
- (a) an amount equal to the amount of the charge-back;
- (b) all third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);
- (c) where you are not a consumer, an administration fee of GBP 25.00 including VAT; and
- (d) all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this Section 6.4 (including without limitation legal fees and debt collection fees).
For the avoidance of doubt, if you fail to recognise or fail to remember the source of an entry on your card statement or other financial statement, and make a charge-back as a result, this will constitute an unjustified charge-back for the purposes of this Section 6.4. This Section does not apply where you are lawfully exercising a right of cancellation, withdrawal or refund, or where the charge-back is otherwise justified.
7.1 Our policies and procedures relating to the delivery of products are set out in our delivery policy document.
7.2 We will arrange for the products you purchase to be delivered to the delivery address you specify during the checkout process. We will not perform any verification or validation of the address details that you specify, and accordingly accept no liability for any items delivered incorrectly (or not at all) due to an error made on your part in specifying the delivery address.
7.3 Unless otherwise agreed, we will deliver the products within 30 days of the day on which the contract comes into force. If we are unable to deliver within that period, we will inform you and you may agree a new delivery period with us or cancel the contract and receive a full refund.
7.4 Where you are a consumer, the risk of loss of or damage to the products passes to you when you (or a person identified by you, other than the carrier) take physical possession of the products. Where you are not a consumer, risk passes on despatch.
8.1 This Section 8 applies if and only if you offer to contract with us, or contract with us, as a consumer — that is, as an individual acting wholly or mainly outside your trade, business, craft or profession.
8.2 As a goodwill commitment that goes beyond the statutory minimum, you may withdraw an offer to enter into a contract with us through our website, or cancel a contract entered into with us through our website (without giving any reason), at any time within the period:
- (a) beginning upon the submission of your offer; and
- (b) ending at the end of 30 days after the day on which the products come into your physical possession or the physical possession of a person identified by you to take possession of them (or, for a contract for the delivery of multiple products, lots or pieces, 30 days after the day on which the last of those products, lots or pieces comes into such physical possession).
8.3 The statutory minimum cancellation/withdrawal period for consumers is 14 days (for example under the UK Consumer Contracts Regulations 2013 and, for EU/EEA consumers, under Directive 2011/83/EU). Our 30-day period is granted voluntarily and in addition to — and never instead of — your mandatory statutory rights.
8.4 To exercise the right to cancel, you must inform us of your decision by a clear statement (for example, a letter sent by post or an email). You may use the model cancellation form set out in Section 9, but you are not obliged to do so. To meet the cancellation deadline, it is sufficient that you send your communication concerning the exercise of the right to cancel before the cancellation period has expired.
8.5 If you cancel a contract on the basis described in this Section 8, you must send the products back to us at SOE Health Ltd, 42D Derby Road, Beeston, Nottingham, NG9 2TG, United Kingdom, without undue delay and in any event not later than 14 days after the day on which you inform us of your decision to cancel. You must bear the direct cost of returning the products. You are only liable for any diminished value of the products resulting from handling them other than what is necessary to establish their nature, characteristics and functioning.
8.6 If you cancel an order in accordance with this Section 8, you will receive a refund of all payments received from you, including the standard costs of delivery (but not any supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
8.7 We will make the refund using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund. We may withhold the refund until we have received the products back or you have supplied evidence of having sent them back, whichever is the earlier.
9.1 The statutory right of withdrawal does not apply to certain contracts, to the extent permitted by applicable law, including in particular:
- (a) the supply of goods made to your specifications or clearly personalised;
- (b) the supply of sealed goods which are not suitable for return for health protection or hygiene reasons and which were unsealed after delivery;
- (c) the supply of goods which, after delivery, are, according to their nature, inseparably mixed with other items.
9.2 Model cancellation form — complete and return this form only if you wish to withdraw from the contract:
To: SOE Health Limited, 42D Derby Road, Beeston, Nottingham, NG9 2TG, United Kingdom — email: info@forestair.life
- I/We hereby give notice that I/We cancel my/our contract of sale of the following goods:
- Ordered on / received on:
- Name of consumer(s):
- Address of consumer(s):
- Signature of consumer(s) (only if this form is notified on paper):
- Date:
10.1 We are under a legal duty to supply products that are in conformity with the contract — that is, of satisfactory quality, fit for purpose and as described.
10.2 If you are a consumer resident in the EU or EEA, you benefit from a statutory guarantee of conformity of at least two (2) years from delivery under Directive (EU) 2019/771 as implemented in your country of residence (in Germany, the statutory Gewährleistung under the BGB). If the goods are not in conformity, you are entitled to have them brought into conformity (repair or replacement) free of charge or, where applicable, to an appropriate price reduction or to cancel the contract.
10.3 If you are a consumer in the United Kingdom, your rights under the Consumer Rights Act 2015 — including the short-term right to reject, and rights to repair, replacement, price reduction or a final right to reject — apply.
10.4 These statutory rights exist independently of, and in addition to, any commercial (manufacturer's) warranty we may offer, and are provided at no cost to you. To make a claim, please contact us using the details in Section 28.
11.1 You warrant and represent to us that:
- (a) you are legally capable of entering into binding contracts;
- (b) you have full authority, power and capacity to agree to these terms and conditions;
- (c) all the information that you provide to us in connection with your order is true, accurate, complete and non-misleading.
11.2 We warrant to you that:
- (a) we have the right to sell the products that you buy;
- (b) the products we sell to you are sold free from any charge or encumbrance, except as specified in these terms and conditions;
- (c) you shall enjoy quiet possession of the products you buy, except as specified in these terms and conditions;
- (d) the products you buy will correspond to any description published on our website;
- (e) the products you buy will be of satisfactory quality.
11.3 All of our warranties and representations relating to the supply of products are set out in these terms and conditions. To the maximum extent permitted by applicable law and subject to Section 12.1, all other warranties and representations are expressly excluded. Nothing in this Section limits your statutory rights as a consumer under Section 10.
12.1 Nothing in these terms and conditions will:
- (a) limit or exclude any liability for death or personal injury resulting from negligence;
- (b) limit or exclude any liability for fraud or fraudulent misrepresentation;
- (c) limit or exclude any liability under applicable product liability law (including the UK Consumer Protection Act 1987 and EU Product Liability rules);
- (d) limit any liabilities in any way that is not permitted under applicable law; or
- (e) exclude any liabilities that may not be excluded under applicable law.
If you are a consumer, your mandatory statutory rights will not be excluded or limited by these terms and conditions, and the limitations in this Section apply only to the extent permitted by the law applicable to you.
12.2 The limitations and exclusions of liability set out in this Section 12 and elsewhere in these terms and conditions:
- (a) are subject to Section 12.1; and
- (b) govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
12.3 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
12.4 Where you are not a consumer, we will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
12.5 You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).
12.6 Where you are not a consumer, our aggregate liability to you in respect of any contract to purchase products from us under these terms and conditions shall not exceed the total amount paid and payable to us under the contract. For consumers, our liability is governed by the mandatory law applicable to you.
13.1 We may cancel a contract under these terms and conditions immediately, by giving you written notice of termination, if:
- (a) you fail to pay, on time and in full, any amount due to us under that contract; or
- (b) you commit any material breach of that contract.
13.2 You may cancel a contract under these terms and conditions immediately, by giving us written notice of termination, if we commit any material breach of that contract.
13.3 We may cancel a contract under these terms and conditions by written notice to you if we are prevented from fulfilling that contract by any event beyond our reasonable control, including without limitation any unavailability of raw materials, components or products, or any power failure, industrial dispute affecting any third party, governmental regulations, fire, flood, disaster, riot, terrorist attack or war. In such a case, any payments you have made for undelivered products will be refunded.
14.1 If a contract under these terms and conditions is cancelled in accordance with Section 13:
- (a) we will cease to have any obligation to deliver products which are undelivered at the date of cancellation;
- (b) you will continue to have an obligation where applicable to pay for products which have been delivered at the date of cancellation (without prejudice to any right we may have to recover the products); and
- (c) all the other provisions of these terms and conditions will cease to have effect, except that Sections 1.3, 6.4, 12, 18, 19, 21, 22, 23, 24, 25, 26, 27 and 28 will survive termination and continue in effect indefinitely.
15.1 These terms and conditions shall not constitute or effect any assignment or licence of any intellectual property rights.
15.2 These terms and conditions shall not govern the licensing of works (including software and literary works) comprised or stored in products.
15.3 These terms and conditions shall not govern the provision of any services by us or any third party in relation to the products (other than delivery services).
16.1 We may revise these terms and conditions from time to time by publishing a new version on our website.
16.2 A revision of these terms and conditions will apply to contracts entered into at any time following the time of the revision, but will not affect contracts made before the time of the revision.
17.1 If you are a consumer habitually resident in the European Union, the EEA, or another jurisdiction whose law provides mandatory consumer protection, you benefit from any mandatory provisions of the law of your country of residence. In accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I), the choice of English law in Section 26 does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of your country of residence.
17.2 Accordingly, where mandatory consumer law of your country of residence grants you rights more favourable than these terms, those rights prevail to the extent of any conflict.
18.1 If you have a complaint, please contact us first using the details in Section 28. We aim to resolve complaints quickly and fairly.
18.2 The European Commission's Online Dispute Resolution (ODR) platform was permanently discontinued on 20 July 2025 and is no longer available. References to it in older terms no longer apply.
18.3 We are not obliged to participate, and do not currently participate, in alternative dispute resolution proceedings before a consumer arbitration board. Consumers in the EU/EEA may nevertheless be entitled to use a competent alternative dispute resolution (ADR) or consumer conciliation body in their own country; this does not affect your right to bring proceedings before the competent courts.
19.1 We process personal data that you provide in connection with your order in order to perform the contract and to comply with our legal obligations.
19.2 Our processing of personal data is described in our Privacy Policy. Where the EU/UK General Data Protection Regulation (GDPR) applies, we process your data in accordance with it, and you have rights including access, rectification, erasure, restriction, portability and objection.
19.3 Please refer to our Privacy Policy for full details, including the legal bases for processing, retention periods and how to exercise your rights.
20.1 Our products are designed to comply with applicable product safety and conformity requirements in the markets in which we offer them (including, where applicable, UKCA and CE conformity).
20.2 Electrical and electronic equipment and batteries must not be disposed of with household waste. Please dispose of them separately at appropriate collection points in accordance with local regulations (including, in the EU, the WEEE and Battery Directives, and in Germany the ElektroG and BattG). This helps protect the environment and human health.
20.3 Please observe the safety instructions in the product manual. Use the product only as intended and described in the accompanying documentation.
21.1 You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions, provided that such dealing does not reduce the guarantees or protections you have as a consumer.
21.2 You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
22.1 No breach of any provision of a contract under these terms and conditions will be waived except with the express written consent of the party not in breach.
22.2 No waiver of any breach of any provision of a contract under these terms and conditions shall be construed as a further or continuing waiver of any breach of that provision or any other provision of that contract.
23.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
23.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
24.1 A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party.
24.2 The exercise of the parties' rights under a contract under these terms and conditions is not subject to the consent of any third party.
25.1 Subject to Section 12.1, these terms and conditions, together with our delivery policy and our returns policy, shall constitute the entire agreement between you and us in relation to the sale and purchase of our products and shall supersede all previous agreements between you and us in relation to the sale and purchase of our products. This does not exclude liability for, or any remedy in respect of, fraudulent misrepresentation.
26.1 These terms and conditions shall be governed by and construed in accordance with English law.
26.2 Subject to Section 26.3, any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
26.3 Nothing in this Section affects the mandatory rights of consumers. If you are a consumer resident in the EU or EEA: (a) the choice of English law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Section 17); and (b) you may bring proceedings against us in the courts of your country of residence, and we may bring proceedings against you only in the courts of your country of residence, in accordance with Regulation (EU) No 1215/2012 (Brussels Ia).
27.1 We will not file a copy of these terms and conditions specifically in relation to each user or customer and, if we update these terms and conditions, the version to which you originally agreed will no longer be available on our website. We recommend that you consider saving a copy of these terms and conditions for future reference.
27.2 These terms and conditions are available in English and German. In the event of any discrepancy between language versions, the English version prevails, save where mandatory consumer law in your country of residence requires otherwise.
